User Agreement

This User Agreement (hereinafter - the "Agreement") regulates the relationship between 1766 TEAM EOOD, a legal entity registered under the laws of the Republic of Bulgaria (hereinafter - the “Administration of the Website") and an unlimited number of individuals and legal entities defined in this Agreement.

Definition of terms and concepts

The website ua-football.com - (hereinafter - the "Website"), located under the domain name www.ua-football.com, is a combination of specially selected and arranged materials (links, texts, drawings, photographs, drawings, audiovisual works and other objects), as well as a set of software and hardware that provide users with access to these materials.

Use of the Website means the posting, viewing, commenting, and rating of Information Materials posted by the Users through the Website Service.

User/Users - individuals or legal entities, including Website Administrator, who use the Website in accordance with the procedure established by this Agreement;

Website Service - the software system of the Website, through which Users can perform the following actions:

• viewing (familiarization) of the posted Information Materials;
• posting comments (text messages) to the posted Information Materials;
• determining the rating of the posted Information Materials.

Information Material - a certain way presented and structured information about events that have recently occurred or are currently occurring, which is of political, social, or economic interest to the recipients of this information (the generalized concept is "News").

The information material may be in the form of text, audio-video recording, photograph, drawing, or any other audiovisual display, which may be placed separately or combined into a group.

Information material may be in the form of a news report, report, interview, news release, article, analysis, conclusions, and other possible forms.

Link - the address of a website page on the Internet. The Link may have the function of displaying information posted on the website page to which the link leads.

Website Administrator - a legal entity or individual who is a User and has all the necessary rights to post Information Materials.

1. Subject of the Agreement
   1. This Agreement governs the terms and conditions of use of the Website.
   2. The current version of this Agreement is available at https://www.ua-football.com/en/terms.
   3. The Agreement may be changed by the Administration of the Website without any prior notice to the User. The new version of the Agreement comes into force from the moment it is posted at the address specified in clause 1.2. of the Agreement unless otherwise provided by the new version of the Agreement. The User is solely responsible for familiarizing with the new versions of the Agreement.
   4. The use of the Website, in whole or in part, means the full consent of the User to all the terms of this Agreement, and is regarded as the fact of the conclusion of this Agreement between the User and the Administration of the Website.
   5. In case of disagreement of the User with any of the provisions of the Agreement, the User shall not be entitled to use the Website.
2. Implementation of the Use of the Website
   1. The Administration of the Website provides the User with the opportunity to use the following information and communication services:
      1. To post Information Materials;
      2. To view (familiarize) the Posted Information Materials;
      3. To post comments (text messages) to the posted Information Materials;
   2. In order to use the Website, the User shall register on the Website.
   3. The Ukrainian version of the Website is installed by default. The User can always change the language in the language bar of the Website (in the upper right part of the web page). The selected interface language changes the default language. The Website displays content and search results in the language selected by the User. You can learn more about how the language settings of the website work and how to change them in the Privacy and Personal Data Protection Policy.
3. Registration of users
   1. To register on the Website, the User must provide accurate and complete information about himself/herself, according to the questions specified in the registration form.
   2. If the User provides incorrect information or the Administration of the Website has reason to believe that the information provided by the User is incomplete or unreliable, the Administration of the Website shall have the right, at its sole discretion, to block or delete the User's account and refuse the User to use the Website.
   3. The Administration of the Website does not verify the accuracy of the information received about the Users and does not verify the legal personality of the Users.
   4. The User shall independently select a unique registration name (Login) from among those available for registration and a password for access to the Website Service.
   5. The User is fully responsible for the security of the login and password used by him/her to access the Website Service and is also fully responsible for all actions that will be performed on behalf of the User using his/her login and password.
   6. The User undertakes not to disclose the login and password used to access the Website Service.
   7. The User shall immediately notify the Administration of the Website of any case of unauthorized (not permitted to the Users) access to the Website Service using his/her login and password.
4. Rights and obligations
   1. The Administration of the Website has the right to:
      1. transfer the Information Materials, links to the Information Materials, comments, messages from one section to another, if, in the opinion of the Website Administration, they relate to the relevant topic;
      2. delete the Information Materials, links to the Information Materials, messages and comments of the Users if they contradict the terms of the Agreement and the norms of the current legislation of Ukraine;
      3. use the copyrighted items provided by the User on the Website in accordance with clause 4.5. of the Agreement;
      4. block or delete the User's account (account) in case of violation of the terms of the Agreement or non-use of the relevant Website Service for more than 1 (one) year;
      5. delete any Information Materials, links to the Information Materials, comments, messages and others posted on the Website
      6. to close access to the Website, in general or to its individual resources, pages, sections, to restrict the provision of the Website Service without prior notice to the Users of such actions. In this case, the Administration of the Website shall not be liable for the termination of user's access to the use of the Website.
   2. The User has the right to:
      1. use the login and password chosen by him/her to access the Website Service after completion of the User's registration process on the Website;
      2. familiarize themselves with, review Information Materials, comments, messages and other materials posted on the Website;
      3. create their own text messages, comments, and exchange opinions on the relevant topics of the Information Material posted;
   3. In case of detection of the facts of illegal use of the Information Materials posted on the Website, the User shall notify the Administration of the Website as soon as possible.
   4. By accepting this Agreement, the User agrees that he/she grants the Administration of the Website non-exclusive intellectual property rights to the Information Materials posted by the User on the Website, namely: non-exclusive intellectual property rights to use, public performance, public notification, public demonstration and public display, any republication of the Information Materials posted on the Website, including the right to transfer (alienate) the above rights to third parties.
5. Restrictions on the Use of the Website
   1. It is prohibited to post and distribute information (comments, messages), materials, including Information Materials, links leading to such materials and information containing:
      1. calls for violent change or overthrow of the constitutional order or seizure of state power; calls for a division of the territory or state border of Ukraine, violation of the order established by the Constitution of Ukraine; calls for civil unrest; calls for aggression or incitement to interethnic, interethnic, military and other conflicts, calls for actions aimed at violation of the legislation of Ukraine, or posting other material that may constitute a criminal offense or cause of its commission;
      2. materials that are illegal; that offend morality, honor and dignity, violate the rights and legally protected interests of third parties; as well as obscene expressions and materials, statements of pornographic, erotic or sexual nature;
      3. advertising and commercial materials, the placement of which is not agreed with the Administration of the Website;
      4. objects of intellectual property, without the appropriate right to such public posting or distribution;
      5. materials containing computer codes designed to disrupt, destroy or limit the functionality of any computer or telecommunications equipment or programs, to provide unauthorized access to the resources of the Website.
      6. personal data of Users or third parties;
      7. materials, the content and/or distribution of which violates the current legislation of Ukraine.
      8. information of a commercial nature related to the User's identity.
   2. Information materials posted by the Users on the Website must comply with the definition of the term "Information Material" specified in this Agreement.
6. Moderation of posted information and materials
   1. Moderation of all materials posted on the Website, including Information Materials, information (comments, messages), links leading to such materials and information is carried out on the principle of post-moderation. All materials and information posted on the Website shall be checked by the moderator only after they are posted.
   2. If the moderator believes that the material or information posted on the Website violates the rules set forth in this Agreement, the moderator has the right to remove such material or information.
   3. Each User shall have the right to send a complaint to the technical support service of the Website regarding the material or information posted on the Website with a request to remove it. If there are grounds provided for by this Agreement or the current legislation of Ukraine, this material or information will be removed.
   4. Users who do not agree with the moderator's decision may write a reasoned objection to the technical support service of the Website.
7. Guarantees
   1. Each User warrants that all materials posted on the Website, including Information Materials, information (comments, messages), links leading to such materials and information, comply with the norms of the current legislation of Ukraine, the requirements of this Agreement, and are not subject to the restrictions specified in Section 5 (Restrictions on the Use of the Website) of this Agreement.
   2. Each User guarantees that he/she has all necessary legal intellectual property rights to the Information Materials posted by him/her (the User) on the Website, namely: non-exclusive intellectual property rights to use, public performance and public notification, public demonstration and public display, any republication of such information materials, including the right to transfer (alienate), granting the above rights to third parties.
8. Responsibility and Indemnification
   1. Each User acknowledges and agrees that he/she is fully responsible for all information (comments, messages) and materials posted by him/her (the User), including the Information Materials on the Website.
   2. Each User acknowledges and agrees that he/she is fully responsible for compliance with all warranties specified in Section 7 of this Agreement.
   3. In the event of any claims, penalties, litigation by third parties or authorized public authorities in connection with the User's violation of the guarantees specified in Section 7 of this Agreement, such User undertakes to consider and resolve all claims, penalties and litigation without involving the administration of the Website or employees of the administration of the Website. The User undertakes to act as a defendant, as well as to compensate the Website Administration or an employee of the Website Administration in full for all documented losses, expenses, including penalties, caused by the User's violation of the guarantees specified in Section 7 of this Agreement.
   4. Each User agrees that all information and materials, including Information Materials posted on the Website by placing (exporting, integrating) links from other Internet websites, are beyond the control of the WebsiteAdministration, and the User accesses such information and materials solely at his/her own risk. The User agrees that the Administration of the Website is not responsible for the availability of such websites, for their content, as well as for any consequences associated with the use of these websites or information and materials posted on these websites by the User.
   5. The Administration of the Website does not carry out mandatory verification of materials and information posted by the User on the Website.
   6. The administration of the Website is not responsible: (1) for the content of information and materials posted on the Ua-football Website; (2) for any statements and comments of Users; (3) for violation of copyright and related rights by Users.
   7. The Administration of the Website is not responsible for any direct or indirect losses, even if the Administration of the Ua-football Website has been notified in advance of the possibility of incurring such losses incurred by Users or third parties in connection with the use and / or inability to use the Website.
   8. The Website Administration shall make all necessary efforts to ensure the uninterrupted operation of the Website, but shall not be liable for the full or partial loss of information and materials of the User posted on the Website, as well as for insufficient quality or speed of downloading such materials and information.
   9. Under any circumstances, the liability of the Website Administration under this Agreement is limited to the amount of UAH 500 (five hundred Ukrainian hryvnias).
9. Intellectual property rights
   1. All exclusive intellectual property rights to the Website are owned by the Administration of the Website, any use by Users or third parties of any component elements of the Website is prohibited.
10. Final provisions
    1. This Agreement and the relations arising from the acceptance of the terms of the Agreement shall be governed by the current legislation of Ukraine.
    2. This Agreement is a Contract of Adhesion in accordance with Article 634 of the Civil Code of Ukraine, and therefore
       1. The Agreement shall be concluded only by accession to it as a whole by the User who has expressed an intention to enter into this Agreement;
       2. The User who has expressed an intention to enter into the Agreement may not propose its own terms of the Agreement;
       3. In case of disagreement with the content and/or form of the Agreement or its individual provisions, the User who has expressed an intention to enter into the Agreement shall have the right to refuse to enter into it;
    3. The User confirms that he/she has entered into this Agreement with a full understanding of the language in which this Agreement is set out, with a full understanding of the content of the Agreement, as well as the terminology used herein.
11. Changes to the Agreement

This User Agreement may be amended and supplemented from time to time and without prior notice to the User, including in the event of changes in the requirements of the law. Please review the Agreement from time to time to be aware of any changes or additions.
